Asbestos
The asbestos diagnosis is mandatory, in case of sale, when the building permit of the property sold was issued before July 1, 1997. It is carried out by a professional diagnostician, according to the terms and conditions in force.
The asbestos diagnosis is inserted in the technical diagnostic file attached to the compromise (or promise) and then to the authentic deed of sale.
It allows the information of the buyer, who thus buys knowingly, and knows whether or not his property contains asbestos.
Asbestos is sought on:
• Flocking, insulation, false ceilings (list A).
• Hard building elements, including roofs, cladding, light facades and ducts in roof and façade (list B).
Depending on the property sold, the owner provides:
• For a detached house: the asbestos identification report relating to its property.
• For a condominium lot :
o The asbestos identification report relating to the private portion of its lot: the asbestos technical file for private portions.
o The summary sheet of the asbestos technical file, for the common areas . This document can be obtained from the syndic of the co-ownership.
• For a building with several dwellings, or premises for use other than housing: the summary sheet of the asbestos technical file.
The seller who does not provide the asbestos report cannot exempt himself from the guarantee of the corresponding hidden defects.

Good to know
In the case of rental of a property for residential use, the Alur law provides that an asbestos certificate is annexed to the lease (buildings prior to July 1997). This provision entered into force in the 1st quarter of 2016. The owners have the obligation to make it available to the tenants.
