The meeting of co-owners

Joint ownership

The syndicate of co-owners takes its decisions at a meeting. In co-ownership, only the assembly can validly make decisions, no other mode of deliberation is possible.

The meeting is held at least once a year, by the syndic, to decide on the accounts for the past year and vote on the provisional budget.

Please note : other meetings may be convened during the year, if necessary.

The meeting is called by the syndic. A meeting may also be called by the President of the trade union council, if the syndic is in default. The judge could also call a meeting if he is seized of a justified request.

All co-owners must be summoned. The convocation is sent by registered letter. It is accompanied by the agenda of the assembly and a number of mandatory documents.

At the meeting of the co-owners, decisions are voted according to different majority rules:
• the majority of the votes cast by the co-owners present or represented, each co-owner having as many votes as thousandths of co-ownership, for current decisions,
• the majority of the thousandths of all co-owners , for a number of decisions, such as the appointment of the trustee.
• a majority of the members of the trade union representing at least two-thirds of the votes, for more important acts.
• unanimity for the most serious decisions.
Minutes shall be drawn up. The syndic has the obligation to notify the decisions of the meeting to the co-owners who opposed them or who were in default.

Good to know

If you cannot go to the general meeting of your co-ownership, you can give a mandate to any other person to be represented, "whether or not the latter is a member of the syndicate". The delegation of votes is limited to three per representative. You must imperatively give your mandate in writing, with or without voting instructions.
