The law of 10 July 1965 on co-ownership recalls that the parts of buildings and land used for the use or utility of all co-owners or several of them are common. The common areas are in principle determined in the co-ownership regulations. In the absence of a specific mention in this act or in the event of a contradiction between the co-ownership regulations and the descriptive state of division, it is necessary to refer to article 3 of the 1965 law which lists the presumed common parts. Misuse of common areas is often the cause of conflicts between co-owners. This can be a congestion of the common areas (strollers and bicycles constantly in the entrance), a monopolization of one of the common areas.
