Ask a neighbour to prune trees

Pruning a tree

Subject: Tree pruning

Dear Madam, Sir,

I allow myself to contact you because I notice that the branches of your trees protrude on my property.

Article 673 of the Civil Code allows me to force you to cut these branches, so I ask you to prune these trees as soon as possible.
In the absence of intervention on your part, I would be obliged to apply to the district court to assert my rights.

Pending an amicable solution, I ask you to believe, Madam, Sir, in the assurance of my distinguished consideration.

Good to know

The law does not allow an individual to prune the neighbour's trees. Thus, if he is allowed to cut roots, brambles and twigs from next door to the edge of his land, he must leave the branches as they are.
On the other hand, if the owner does not fulfill this pruning obligation, his neighbors can ask him to comply. This principle is laid down in article 673 of the Civil Code: " Whoever on whose property the branches of the trees, shrubs and shrubs of the neighbor advance may force the latter to cut them."
